Accident of Innocent animal

My car was moving with high speed on National Highway. A truck was coming in the other lane a little behind to car. Suddenly a bull appeared and started crossing the road. It had a limp which slowed its speed. It was in the middle of the road then decided to go back. As larger vehicle was coming in that lane, it decided to continue its journey to cross the road. Its indecisiveness confused my driver. The distance was too less and speed was too high. It seems for a few seconds bull will be killed. But driver took a fast decision, put the harsh brakes. The car only touched the animal with the slightest pressure.

Consequently my back ached the whole day but I was relieved an animal is SAVED.

Who is responsible for such accidents on roads; the owner who leave innocent animals without giving any food or the driver who even with careful driving hit these animals because of high speed?

  1. There should be some strict rules about cattles and other animals plying on road. If a vehicle is parked uncaringly, its a bookable offence. Like that, careless animals owners should be punished for their deliberate action.

  2. according to law..if a man comes in the middle of the road and is hit.. driver is responsible for rash driving.. so the same applies to other creatures.. it may seem harsh.. but car/truck drivers always think they own the road..because they are in their safe metal cage..

  4. There are speed limits even in highway. Just because there is no vehicle, one cannot ride at 150 kms speed. There should be highway cameras to control the speed.
    And obviously, we cannot blame the poor animal. But, good thing is that, its safe.

  7. DEFINITELY not the driver.. how is he responsible roads are for vehicles not animals or humans..

    I think when such things happen it should be local council who are responsible for road maintenance to be blames, they shud make sure such things dont happen, build a fense or something so animals dont wander out into the road..

    and as @Sankoobaba said if a man comes and gets hit the law DOESNOT say its the drivers fault.. it is drivers fault if he is driving RASHLY, or under some influence..

    I am sure the man on road is booked for attempt to suicide.. thats is a other story that police takes this as money making chance so they will do anything BUt the law doesnot say that .

  10. surely the animal owners, but more importantly the government which has no rules for protecting animals... our national animal tiger is itself left uncared by government... how do u expect them to take care of bulls and goats... ur driver has done a great job by protecting the animal...

  11. In my opinion the owner of the animal is responsible. They don;t feed their animals properly which makes the animals wander here and there for food and they often get killed by accidents on highways.

  12. The owner of an animal is responsible for the consequences of the animals' actions - the responsibility is the other side of the benefit he gets from "owning" the animal.

  14. What if there was an open gutter on the road and the car touched the gutter instead of the poor creature? Could you come out with just an aching back? I suggest, whatever you do, take a complete charge of it. The car should have been in complete control of the driver and the driver should have been under your control. So, it is you who is ultimately at fault... What do you say? :)

  17. Owner of the cattle is more responsible, but drivers should also drive at a speed they can control and stop suddenly.

  18. sometimes, there aren't any owners... They are just stray animals. In that case, you cannot do much.. But for those who own these animals, it is their responsibilty to take proper care...

    I lost my dog because he wandered away from home. And we found him dead on the road... I couldn't even blame the guard for letting him out of the gate... Not even the driver who drove over him coz I dont know what happened snd how it happened. And I cant even blame anybody at home coz everybody loved him... What do you do in that case... Whom do you blame...

    On highway a driver has to keep his or her sights much ahead provided visibility is enough or lessen speed. It is not necessary it could be a domestic cattle as it can be a stray wild one too.

  20. @sathish: one can't blame the govt. in nation like ours, where we ought to scratch our heads for bigger problems in our daily lives. The point here is, every animal's responsibility lies on ots owner, and a great care shud taken by everone else, instead of takin them for granted as an entertainment(thepeople around the scene)...
